MyStor is a marketplace platform operated by BYTE CLUB, obrt za računalno programiranje i usluge, established in the Republic of Croatia ("BYTE CLUB", "we", "us", or "our"). These Terms of Service ("Terms") govern your use of the MyStor mobile application and related services (the "App"). By creating an account or using the App, you agree to these Terms. If you do not agree, do not use the App.

Definitions

  • "MyStor" – the marketplace platform and brand operated by BYTE CLUB.
  • "we", "us", "our" – BYTE CLUB, not any Provider using the App.
  • "User", "you" – refers to any individual who accesses or uses the App.
  • "Customer" – a User who posts jobs or requests services through the App.
  • "Provider" – a User who has been verified and offers services through the App.
  • "Job" – a service request posted by a Customer, including its description, photos, location, and category.
  • "Offer" – a proposal submitted by a Provider in response to a Job, including a price and estimated timeline.
  • "Provider Service" – the repair, maintenance, visit, or other physical service supplied directly by a Provider to a Customer.
  • "Platform Service" – MyStor's service of connecting a Customer with a selected Provider and confirming the booking.
  • "Platform Fee" – the amount charged by BYTE CLUB for the Platform Service and displayed immediately before the Customer is bound.

Eligibility

You must be at least 18 years old and legally capable of entering into binding contracts to use the App. By registering, you represent and warrant that all information you provide is accurate, current, and complete, and you agree to keep it updated.

Account Registration

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use. We reserve the right to suspend or terminate accounts that violate these Terms or exhibit suspicious activity. You may not transfer or share your account with another person.

Provider Verification

Providers must complete the identity and business-verification steps required in the App before offering paid services. Depending on the Provider and jurisdiction, this may include identity documents, a selfie or liveness check, tax and trade-register details, licences, insurance information, and payment-account details. A verification check confirms only the information reviewed at that time; it is not an endorsement or guarantee of the Provider's skills, legal compliance, insurance, or work quality. Providers must keep their information current and remain legally entitled to perform every service they offer.

Platform Role

BYTE CLUB supplies the Platform Service. Providers independently supply Provider Services under a separate contract made directly with the Customer when an Offer is accepted. BYTE CLUB does not employ, direct, supervise, or control Providers and is not a party to the Provider Service contract. Provider verification, messaging, status tracking, and dispute tools do not make BYTE CLUB the supplier of the Provider Service. Nothing in these Terms excludes BYTE CLUB's responsibility for its own Platform Service or any right or liability that applicable law does not permit us to exclude.

Jobs and Offers

  • Customers may post Jobs describing the work they need done, including photos, location, and category.
  • Providers may submit Offers on Jobs with their proposed price and estimated timeline.
  • Before acceptance, the App identifies the Provider, the proposed Provider Service, the Provider's price, and the separate Platform Fee. Acceptance creates a Provider Service contract directly between the Customer and Provider and a separate Platform Service contract between the Customer and BYTE CLUB.
  • Both parties are expected to communicate clearly, act in good faith, and fulfil their obligations.
  • Cancellation of a Provider Service does not automatically cancel or refund a Platform Service that has already been fully performed, except where these Terms or mandatory law provide otherwise.

Payments

  • Platform-Fee-Only Model. MyStor charges the Customer only the Platform Fee shown immediately before acceptance. The displayed fee is the controlling price for that checkout; fee rates or minimums may change for future checkouts but never after the Customer confirms a specific payment. Stripe processes the Platform Fee for BYTE CLUB. MyStor does not deduct a fee from the Provider's agreed price or send a Provider payout in this model.
  • Direct Provider Payment. The Customer pays the Provider's price directly to the Provider using the method and timing they agree, such as cash or bank transfer. MyStor does not collect, hold, escrow, guarantee, or transfer that payment. The Provider—not BYTE CLUB—is responsible for collecting the price and handling any refund of it.
  • Paid Site Visits. A visit offer may state a Provider visit price. In the platform-fee-only model, the Customer pays that visit price directly to the Provider. At acceptance, MyStor charges only the separately displayed Platform Fee calculated for the visit booking.
  • Immediate Performance and Withdrawal. Before paying, a consumer must expressly request that BYTE CLUB perform the Platform Service immediately during the 14-day withdrawal period and acknowledge that the withdrawal right for that service is lost once the Offer is accepted, the Platform Fee payment succeeds, and the booking is confirmed. We preserve the wording, version, time, and transaction details of that request in a durable contract confirmation.
  • Invoices and Taxes. BYTE CLUB issues the receipt or invoice required by applicable law for its own Platform Fee; where Croatian fiscalization applies, BYTE CLUB's fiscal invoice covers only that fee. The Provider must operate lawfully and issue and fiscalize any invoice, receipt, warranty document, or other record required for the Provider Service. A MyStor transaction summary is not the Provider's service invoice.
  • Platform-Fee Refunds. Because the Platform Service is fully performed when the booking is confirmed, a later Customer cancellation, no-show, or decision to complete the work outside the App does not normally refund the Platform Fee. We will refund the Platform Fee for a duplicate charge or a failed booking caused by our technical error, when the selected Provider independently cancels and no reasonable replacement is provided, and whenever mandatory law requires a refund. Provider-price disputes and refunds must be resolved with the Provider.
  • Third-Party Fees. MyStor is not responsible for any fees, charges, exchange-rate differences, or issues imposed by your bank, card issuer, payment provider, or payment processor.

Reviews and Ratings

Users may leave reviews and ratings after completing a job. Reviews must be honest, factual, and based on genuine experience. Reviews must not contain hate speech, personal attacks, discriminatory language, or defamatory content. We reserve the right to remove reviews that violate these Terms, our community guidelines, or applicable law.

Prohibited Conduct

You agree not to:

  • Use the App for any unlawful, fraudulent, or deceptive purpose
  • Impersonate any person, entity, or falsely claim affiliation with any organisation
  • Submit false, misleading, or inaccurate information in your profile, jobs, or offers
  • Harass, threaten, stalk, or abuse other Users in any way
  • Circumvent the MyStor booking flow or avoid a Platform Fee; this does not prohibit the direct payment of a Provider's price where the App states that direct payment is required
  • Upload viruses, malware, or any content intended to compromise the App's security or infrastructure
  • Use automated tools, bots, or scrapers to access, monitor, or copy any part of the App
  • Solicit personal information from other Users for purposes unrelated to a Job
  • Post content that infringes on intellectual property rights of any third party

Disputes

Customers and Providers should first try to resolve Provider Service issues directly through App messaging. Either party may then use the App's dispute tools. MyStor may review booking records, messages, timestamps, status history, uploaded evidence, and Platform Fee records. Any decision by MyStor controls only platform actions that MyStor can take, such as account status or a Platform Fee refund. It is not a court judgment, does not decide ownership of money paid directly to a Provider, and does not prevent either party from using a competent court, consumer authority, or available alternative-dispute process.

Intellectual Property

The App, including its design, source code, branding, and content created by BYTE CLUB, is owned by BYTE CLUB or its licensors and is protected by applicable law. Content you upload remains yours. You grant BYTE CLUB a non-exclusive, worldwide, royalty-free licence to host, reproduce, adapt for technical display, and show that content only as reasonably necessary to operate, secure, and improve the App and provide the features you request. You confirm that you have the rights needed to upload the content.

Limitation of Liability

To the maximum extent permitted by law, MyStor shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to damages for loss of profits, data, or other intangible losses. Nothing in these Terms limits any consumer rights, statutory warranties, or other rights that cannot be excluded or limited under applicable law.

Indemnification

To the extent permitted by law, a User acting in the course of a trade or business will compensate BYTE CLUB for third-party claims and reasonable costs caused by that User's unlawful content, Provider Services, or material breach of these Terms. This section does not apply to a consumer beyond liability the consumer has under mandatory law.

Service Availability

The App is provided on an "as is" and "as available" basis. We do not guarantee that the App will be uninterrupted, error-free, or available at all times. We may perform scheduled or unscheduled maintenance, updates, or upgrades that temporarily affect availability. We are not liable for any loss or inconvenience caused by downtime or unavailability of the App.

Termination

You may stop using the App and request account deletion at any time, subject to resolving active bookings, disputes, unsettled payments, and records that must be preserved by law. We may restrict or suspend an account where reasonably necessary for security, fraud prevention, legal compliance, user safety, non-payment of a Platform Fee, or a material breach of these Terms. Where appropriate, we will give reasons and a way to contact support. Personal data is handled after termination under our Privacy Policy.

Changes to Terms

We may update these Terms to reflect legal, security, technical, or service changes. We will identify the effective date and give advance notice of material changes where reasonably possible. If a change materially affects an existing agreement or requires consent by law, we will request affirmative acceptance before the changed term applies. Changes do not alter a Platform Fee or booking already confirmed unless the parties expressly agree or the law requires it.

Governing Law

These Terms are governed by Croatian law. If you are a consumer, this choice does not deprive you of mandatory protections of the country where you habitually reside, and you may bring proceedings in any court available to you under applicable consumer and procedural law. For Users acting in the course of business, disputes are submitted to the competent court determined under applicable Croatian procedural law.
